Indemnification Provisions
Contractual indemnification clauses are among the most overused and misunderstood provisions that parties argue over and negotiate for. This panel will address analysis of such clauses, the interplay between those clauses and so-called anti-indemnity statutes, and current developments in the law concerning these issues, including what makes an indemnification agreement enforceable; and how courts analyze indemnification clauses.
